1. SCOPE:
The following General Terms and Conditions (the "GTCs") govern your access to and use of the Chefland online site located at the domain name www.chefland.ch (the “Website”) and the orders settled by 4.0 Sagl ("Chefland"). By accessing and using the Website, you acknowledge that you have read and understand these GTCs and you accept and agree to be bound by the terms of use. You may not access, display, use, download, and/or otherwise copy distribute content obtained on the Website for marketing and other purposes without the express consent of Chefland.
Chefland reserves the right to revise the GTCs at any time without notice. The version of the GTCs at the time the order was placed will serve as the governing rules.
2. Offer
Offers on the Chefland site are intended for private customers residing in Switzerland or the principality of Liechtenstein. Shipments will only be made to valid addresses in Switzerland or Liechtenstein.
Offers are valid only when visible on the Chefland site and whilst supplies last. We reserve the right to make changes to prices and product selection without notice and to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged and we cancel your order, we will issue the credit to you credit card. Individual bank policies dictate when this amount is credited to your account. All product photos on our site are intended as a reasonable representation of the actual product and may not always contain accurate product information. We are not responsible if information made available on the Website is not accurate, complete or current.
3. Price
All prices are shown CHF (Swiss francs) and include the applicable Swiss VAT. All prices in the Chefland store at the time the order is processed and accepted shall be considered the final price.
4. Orders
The product displays (including but not limited to name, description, price, weight, etc) on the Chefland store are not a legally binding promise but a non-binding presentation of our catalogue. Chefland reserves the right to limit or cancel quantities of products purchased per person, per household or per order or to decline a delivery should the order be exceptionally heavy. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. Additionally, we may limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers, distributors or any other unauthorized party. You are not permitted to resell any products or services purchased through the Website for commercial purposes.
By purchasing any product or service from us, you confirm that you are at least 18 years old and have read and agreed to our Terms & Conditions.
Upon clicking the "buy" button, the purchase will be considered finalised and subject to the GTCs. Shortly after the submission of the order, a confirmation will be sent to the email address that you have provided when the order was made.
Customers may only revise or cancel an order prior to it being processed by Chefland. Should an order be changed, all original pricing and will be used to calculate the final cost.
By purchasing from the Website, you agree that we may share information about you and your transaction with other entities for various purposes, including (without limitation) to process your transaction, to collect on any unpaid debt and to obtain credit card authorization. The private information required for executing the orders placed through the Website, namely your personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by Chefland. Credit card details are not kept by Chefland under any circumstances.
Chefland will only deliver to customers with a valid address in Switzerland or Liechtenstein.
All estimated delivery days can be seen on the Chefland site though it is not possible to provide an exact delivery time. Exceptions may occur however on peak shopping days or holidays when it is not possible to deliver within the stated times. Deliveries are made Monday-Friday via Swiss Post. No deliveries are possible on national or Cantonal holidays or on Sundays. It is not possible to claim any monetary compensation for shipping delays.
Chefland will supply all goods to the delivery company (namely Swiss Post) in good order. Chefland will not be held liable for the condition of goods arriving at your chosen delivery address.
6. Shipping costs
For standard orders, Chefland uses three tiers of Swiss Post pricing:
Depending on the order total and weight. Most orders of CHF100 or more will receive free shipping. For orders in excess of 30kg a custom shipping price will be determined.
7. Defective products
Should a product arrive with obvious damage to its packaging or its contents, It is your responsibility to contact the courier (normally Swiss Post) and refuse the parcel. Any damage occurring from transport must be reported on the day of delivery to Chefland via email at info@chefland.ch.
It is your responsibility to properly inspect all products immediately upon receipt and to store them appropriately.
In the event of a claim for defective products, Chefland reserves the right to request proof of such defects in the form of photos or videos. Any proof of defects must be received by Chefland on the day of delivery.
8. Payment options & Refunds
Payments are only accepted in Swiss francs via a credit card such as Visa, Mastercard, American Express, and also standard debit cards. All debits are made once the order has been successfully processed by Chefland.
Should a customer be entitled to a refund, credits will be sent directly to the customer's credit card used for the purchase.
9. Indemnification
You agree to defend, indemnify and hold Chefland, its directors, officers, employees and agents harmless from any and all damages, claims, liabilities, costs and expenses, including, but not limited to, reasonable legal fees, arising from your use, or your inability to use the Website or that may be sustained as a result of using the products sold on the Website.
10. Termination
We may terminate, change, suspend, restrict or discontinue any aspect of the Website at any time if we believe you are in breach of the GTCs or applicable law, or for any other reason at our discretion, without notice or liability. These GTCs will terminate commensurate with the discontinuance or termination of your Website use privileges. However, the GTCs will nevertheless continue to apply and be binding upon you and any persons you represent, regarding your prior access to and use of the Website and the Website content.
